Brival Fin provides a predictive analytics platform intended to help businesses assess, allocate, and monitor idle capital reserves. The Service may include dashboards, reports, notifications, and related tools. Brival Fin does not provide financial, investment, tax, or legal advice, and outputs from the Service should not be treated as a substitute for professional guidance.
3. Eligibility and Account Registration
You must be authorised to act on behalf of the organisation you represent when registering for the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use of your account.
4. Subscription, Fees, and Payment
Certain features of the Service may require payment of fees as described at the time of purchase. Fees are billed in advance on a recurring basis unless otherwise stated. All fees are non-refundable except where required by applicable law or expressly stated otherwise. We reserve the right to change our pricing with reasonable advance notice.
5. Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting unauthorised access to systems or data, reverse engineering any part of the Service, uploading unlawful or infringing content, interfering with the normal operation of the platform, or using the Service to build a competing product. We reserve the right to suspend or terminate access for any violation of this section.
6. Customer Data
You retain ownership of any data you submit to the Service ("Customer Data"). You grant Brival Fin a limited licence to process Customer Data solely for the purpose of providing, maintaining, and improving the Service. You are responsible for ensuring you have the necessary rights to submit any data you provide to us.
7. Intellectual Property
The Service, including its software, design, branding, and underlying technology, is owned by Brival Fin or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you, except for the limited right to use the Service as expressly permitted.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Brival Fin does not warrant that the Service will be uninterrupted, error-free, or that any predictive output will be accurate or suitable for your specific circumstances.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Brival Fin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability arising from these Terms shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe such action is necessary to protect the Service or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, subject to any provisions that survive termination.
11. Changes to the Service and Terms
We may update or modify the Service and these Terms from time to time. Where changes are material, we will make reasonable efforts to provide notice. Continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Brival Fin is registered, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
